Welcome to iMkulima. These Terms of Use ("Terms") govern your access to and use of the iMkulima mobile application, website (https://imkulima.com), and services (collectively, the "Services").

By creating an account or using our Services, you agree to be bound by these Terms. If you do not agree, you may not use the Services.

1. Eligibility and Account Registration

• Age: You must be at least 18 years old to use iMkulima.
• Account Accuracy: You agree to provide accurate, current, and complete information during registration and to keep your account details updated.
• Security: You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.

2. The iMkulima Services

iMkulima provides AI-driven agricultural tools including, but not limited to:

• AI Crop Scan: Disease detection and pest identification.
• Smart Advisory: Weather forecasting and irrigation guidance.
• Agri-Market Connect: A marketplace for buyers and sellers of agricultural products.

3. AI Disclaimer and Limitation of Liability

• Advisory Nature: Our AI crop disease detection and irrigation models are advisory tools only. While we strive for high accuracy, the results are generated by algorithms and may occasionally be incorrect.
• No Professional Guarantee: iMkulima does not guarantee a specific yield or the total eradication of pests and diseases.
• User Responsibility: You are encouraged to consult with local agronomists or extension officers for critical farming decisions. iMkulima Tech is not liable for crop loss or financial loss resulting from reliance on AI recommendations.

4. Marketplace Terms (Agri-Market Connect)

• Transaction Role: iMkulima provides a platform to connect buyers and sellers. We are not a party to the actual contract of sale between users unless explicitly stated.
• Quality of Goods: Sellers are responsible for the quality, safety, and legality of the items listed.
• Payments: If you use our integrated payment escrow, funds will be held securely and released according to our transaction milestones.

5. Prohibited Conduct

You agree not to:

• Use the Services for any illegal purpose or in violation of Kenyan law.
• Upload fraudulent or misleading information about crop health or marketplace listings.
• Attempt to reverse-engineer the AI models or scrape data from the platform.
• Post offensive, defamatory, or harmful content in the community forums.

6. Intellectual Property

• Our Content: All software, AI models, logos, and trademarks are the exclusive property of iMkulima Tech.
• Your Content: You retain ownership of the photos you upload for scanning. However, you grant iMkulima a license to use anonymized data from these scans to improve our AI models.

7. Fees and Payments

Certain features of the Services may require payment of fees. All fees are non-refundable unless otherwise required by law or specified in a specific service tier.

8. Termination

We reserve the right to suspend or terminate your account at our discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users or the iMkulima brand.

9. Governing Law

These Terms are governed by and construed in accordance with the Laws of the Republic of Kenya. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the Kenyan courts.

10. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via the app or email. Continued use of the Services after such changes constitutes acceptance of the new Terms.
